6. Terms & Conditions
Orders are confirmed after successful payment or COD verification call. We reserve the right to cancel orders if items are unavailable. All brand content, logos, and website design are exclusive property — unauthorized reproduction is prohibited.
6.8 Limitation of Liability
- Website Downtime: We are not liable for losses arising from website unavailability, technical outages, or third-party service failures (payment gateways, courier portals).
- Shipping Delays: Once dispatched with a tracking number, delays by logistics partners are outside our direct control. We will liaise with the courier but cannot be held liable for consequential losses.
- Maximum Liability Cap: Our total liability for any claim shall not exceed the total value of the order amount paid for the affected transaction. We are not liable for indirect, incidental, or consequential damages.
Nothing in this clause limits liability for death or personal injury caused by our negligence, or any right that cannot be excluded under UAE Consumer Protection Law No. 15 of 2020.
6.9 Force Majeure
We shall not be liable for failure or delay caused by events beyond our reasonable control, including:
- Natural disasters (floods, sandstorms, earthquakes)
- Government actions, trade embargoes, or regulatory bans
- Logistics strikes, port closures, or airline cargo suspensions
- Pandemics or UAE government-mandated shutdowns
- Cyberattacks or large-scale infrastructure failures
If a Force Majeure event causes a delay exceeding 30 days, either party may cancel the order and a full refund will be issued.
6.10 User Account Responsibility
- You are solely responsible for keeping your account password and credentials confidential.
- All orders placed through your account are deemed authorised by you.
- If you suspect unauthorised access, contact us immediately at support@rifaahdubai.com — we will suspend your account upon identity verification.
- We reserve the right to suspend accounts used in violation of these terms or involved in fraudulent activity.
⚠️ We will never ask for your password via WhatsApp, email, or phone. Any such request is a phishing attempt — report it to us immediately.
6.11 Sanctions & Restricted Countries
In compliance with UAE federal law and payment gateway requirements:
- We will not provide products or services to any individual or country listed on the OFAC Specially Designated Nationals (SDN) list or subject to comprehensive OFAC sanctions.
- Orders from sanctioned destinations (currently including Iran, North Korea, Cuba, Syria, and Crimea/Donetsk/Luhansk regions) will not be accepted.
- We reserve the right to cancel and refund any order found to involve a sanctioned party — even after payment.
- All transactions are screened against OFAC and UAE Central Bank sanctions lists as part of our payment workflow.
These terms are governed by UAE Federal Law and the laws of the Emirate of Dubai. Disputes shall be submitted to the competent courts of Dubai.
